The website www.fagottobooks.gr is provided, as is, by the company «NIKOS THERMOS & Co IKE» with the distinguishing title FAGOTTOBOOKS CO, based in Athens, Greece at 15 Valtetsiou Street (henceforth Fagottobooks Co.) VAT No. 800703555, under the terms and conditions set forth in this notification. Every user accessing and transacting or making use of the services of our electronic shop is considered to have agreed and unreservedly accepted the terms herein. Should he or she not agree wit the terms they must abstain from use of the electronic shop and any transaction with them. Fagottobooks Co. maintains the right to alter the terms of use at any time.

Copyright and Industrial Design property

The contents and information provided by the website, including its indicative deign, distinguishing characteristics, logotypes, graphics, texts, documents, photographs, data bases, and in general all distinguishing elements and copyright of the website constitute Fagottobooks Co.’s copyright and industrial design property, protected by the relative provisions of Greek and EU legislation as well as international contracts. Exceptionally, the books, magazines and the rest of the products on offer for sale remain under copyright of their publishers, individual and/or legal representatives registered as the proprietors of the related rights. Any copy, transfer or creation of business based on the content or misleading the public as to the real provider of the electronic shop is prohibited. Reproduction, diffusion, propagation, broadcasting of the material, or any other use of the content in any other fashion or means for commercial or other purpose is permitted only following a previous written agreement by Fagottobooks Co. or any other proprietor of the copyright.

Fagottobooks Co. controls but is not responsible for an eventual price rise of their products on the part of their publishers-suppliers Their data base is updated on a daily basis in order better to keep their users informed, without bearing responsibility for titles missing from the publishers’-suppliers’ stocks nor for exhausted products. They also keep reservations and are not responsible for eventual technical errors or misprints made unwittingly or by oversight or are due to force majeure, which they are willing to rectify if they come to their notice. Fagottobooks Co. maintains the right to interrupt, postpone, modify or alter the services and information offered at the website in question here, at any time and without forewarning.

Fagottobooks Co. invites their publishers/suppliers to keep an eye on the data of their products as stand in this website and to inform the Company immediately, according to the provision of Law no.2557/97 in regard to any reissue or adjustment of the sales price of their products.

Responsibility of the Company

Fagottobooks Co. is entirely in alignment with the provisions of the Civil Code in regard to sales, as well as of Law no.2251/1994 for the Protection of the Consumer as it has been modified and is in force.

In the framework of Fagottobooks Co.’s transactions from the electronic shop, the user is informed on the basis of the data regarding availability or not of the products and can in no circumstance t guarantee their availability. They undertake in every case timely to inform the user of the non-availability, and therefore bear no further responsibility. Any payments eventually having been made for non-available or exhausted products will be reimbursed to the user with no unjustified delay in the same manner as the user selected to pay for his or her purchase.

Fagottobooks Co. bears no responsibility for any eventual damage caused to the user from having accessed and employed the contents and information offered nor services rendered by the website. Fagottobooks Co. takes the necessary protective measures for the serviceable functioning of the website in question, however does not guarantee that the contents, web pages and technical facilitations or possibilities offered by the website will infallibly be provided and be problem-free, nor that the website and servers connecting it to the visitors’/users’ computer will be provided without damaging applications installed without their knowledge.

User Registration

Any person may freely visit Fagottobooks Co.’s electronic shop without needing to provide personal data.

A user registering with the electronic shop is obliged to give complete and accurate data. Upon registration the user is asked to submit the data: a) Name and surname of individual/legal representative; b) Address/seat; c) Postal code; d) Telephone number; e) E-mail address. If the user should ask for an invoice he must submit his or her profession, VAT No. and Tax Office. Fagottobooks Co. retain the right to cancel a user’s account if it is ascertained that the declared data are inaccurate or ithey have not been connected to the account in the last 9 months, or that they have never undertaken a transaction, or that they have misused their account, or intends to adulterate the web page or its aspect.

What is Personal Data?

Personal data is every information that relates to and describes a person such as: identification information (first and last name, age, residence, occupation, family situation etc.), physical features, education, profession (work experience, work conduct, etc.), financial situation (income, assets, financial conduct), interests, activities, habits.

It refers to any operation that involves personal data such as: collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction. All use or processing of data related to the users or non-users and their digital footprint, undertaken by fagottobooks, respects fully the terms of the GDPF.

Which of your data do we collect?

A) User account creation
In order to create your account in fagottobooks, you need to provide your email and your own password. When your account is created you can submit your orders, see your purchase history, your billing and delivery information and your favorite products.

B) Orders execution
a) First and Last name of natural person/legal person, b) Address/Company Head Office, c) Postal Code, d) Telephone Number, e) E-mail. If the costumer wishes an invoice he has to provide us with his occupation, Tax Registration Number (ΑΦΜ) and Tax Office (ΔΟΥ). The subscribed users can select their favorite books and add them to a list, which cannot be accessed by fagottobooks.

C) Store communication form
In the “communication” field of the website, the costumer who wishes to communicate with fagottobooks via the communication form, has to provide his first and last name and email address in order for fagottobooks to be able to respond.

D) Newsletter subscription
Every visitor can subscribe to the newsletter of fagottobooks by providing just his email.

E) Submitting information to the Musical Education catalogue
The Musical Education catalogue contains information of businesses and the only personal data that can be submitted, with the consent of the individuals, is the following:

— Individual’s email
— Individual’s email
— Names of professors

You can ask for the erasure of any of the above personal data from the Head of Data Protection at the address Valtetsiou 15, Athens, 10680 or at the email address info@fagottobooks.gr.

How do we use your data?

A) User account creation
Fagottobooks processes your personal data in order to provide you with the services of your account and facilitate the purchase of products and/or services

B) Processing of Orders
Fagottobooks processes your personal data in order to fulfill its contractual relationship, to execute product and/or services orders, to offer customer support services, to comply with legal obligations, to reject, make or execute legal requirements. In case fagottobooks does not receive your personal data either from our physical store or from our e-shop upon completion of the order, we will not be able to process and execute your order and abide by the legal obligations. It may be needed to transfer your personal data to third parties for the supply or delivery of the products or services that you have ordered. Furthermore, we can keep your personal data for a certain time period in order to fulfill our contractual obligations, such as product returns, as provided by law. Fagottobooks has access to your purchase history and can use it only for statistical purposes regarding the sales rates of the products. We will never use your personal data for other kinds of statistics nor will we share it with third parties.

C) Data registration in the Music Education catalogue
This data exists on the fagottobooks website for the users’ information.

D) Communication form with the store
Fagottobooks uses your personal data in order to reply to your demands/inquiries, requests for money return and/or complaints. We use the information you share with us to manage your requests and fulfill them in the best possible way. Fagottobooks can also keep an archive of your inquiries/requests in order to respond better to any future communication, according to our contractual obligations towards you, our legal obligations as well as our legal interests so that we can provide the best possible services and be able to improve our services based on your own personal experience.

E) Newsletter subscription
Fagottobooks uses the data you have submitted when you subscribe to the newsletter in order to send you notifications regarding new editions, new product arrivals, offers and articles by the fagottobooks blog.

Who is the recipient of your personal data?

A limited number of fagottobooks’ staff has access to your personal data, bound by confidentiality agreements, as well as our cooperating enterprises or third party service providers that process your personal data as they perform these tasks on behalf of fagottobooks and according to its demands.

Which applicable law governs our processing of your data?

The applicable law is the Greek Law, which follows the General Data Protection Framework 2016/679/EU, and generally the applicable national and European legal and normative framework for the protection of personal data. The Court of Athens is the competent court for any differences that might emerge in relation to your personal data.

What if I am minor?

The use of the pages and services of our current website by a minor user/visitor is permitted with the consent of their parents or legal guardians.

Payment by credit card

For security reasons Fagottobooks Co. does not store the data of any credit card for future use and the user must therefore reintroduce the data every time they wish to proceed to a transaction. The company keeps only communication data such as name and surname, address and telephone number. Personal data are secured by the use code the customer gives upon becoming a member of www.fagottobooks.gr.

On entering the required data for a credit card the user explicitly declares that has legal right of use of the card and declares the user’s agreement to the binding of the amount of the purchase and, at completion of the purchase, the debiting of the card.

In the case when a transaction by credit card is rejected, for whatever reason, by the issuing bank or the card’s network – indicatively such reasons may be exceeding the credit limit or suspicion of fraud – the user will then be considered as not having completed the purchase. If a purchase is not completed , with participation of the customer, Fagottobooks Co. is obliged to release the amount of the purchase from the credit card.

Transactions by credit card are carried out using the services of Eurobank, the provider of Processing Internet Payments, with whom Fagottobooks Co. is in cooperation. The high security level of Eurobank’s services is ensured by the following:

— Information relating to the card (card number, CVV2, expiry date) are transmitted/transferred via Internet in coded form (128-bit encryption) and are not accessible from our electronic shop. The systems and procedures employed by the services exclude access to their data and information systems.

— The bank’s web page on which you enter your card’s data has a digital certificate so that anybody may check its legitimacy, that is ascertain that it does belong to the services.

— The services follow the best international practices in the field of electronic commerce payments and are additionally fully compatible with VbV (Verified by Visa) specifications for secure online credit card payments.
